Housing Disrepair is the catch-all industry term for damage, internally or externally, that makes or contributes towards conditions which make a property not suitable for human habitation.
The Housing Health and Safety Rating System is commonly used to assess hazards which contribute towards unsafe conditions. There are currently 29 hazards within the system which fall into four categories; physiological, psychological, infection and accidents.

As Surveyors we are experts in not only identifying the presence of these hazards but also advising on how to remedy them and ensure the property is once again habitable, or even prevent them in the first place.

The legal process as a result of disrepair
All disrepair claims have two sides to the story, with the landlord on one side and the tenant on the other. The Landlord and Tenant Act 1985 is the legislation that underpins the legal process of all disrepair claims. Claims are heard by the First Tier Tribunal (Property Chamber) where the landlord will defend that they have not breached the Act and the tenant will assert that the Act has been breached.

Housing disrepair claims are becoming more frequent. Statistics show that between 2020 and 2024 the number of claims rose by 392%. This has lead to a shortage of professionals to deal with the claims as supply catches up to the explosion in demand. It is now more important than ever to make sure that a claim is supported by evidence provided by a credible expert, which is where we can assist.
